✅ 1. Acceptance of Terms

Welcome to JUP Game Studio! By downloading, installing, accessing, or using any application, game, or service ("Services") published by JUP Game Studio ("Company", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms").

These Terms apply to all applications, games, and services published by JUP Game Studio, both currently available and released in the future. If you do not agree to these Terms, please do not use our Services. Your continued use of any Service after any changes to these Terms constitutes your acceptance of the revised Terms.

2.1 Age Requirements

Our Services are intended for users who are at least 7 years of age (as indicated by our app store ratings). However:

• Users under 13 years of age may only use our Services with verifiable parental consent
• Users under 18 years of age must have their parent or legal guardian review and agree to these Terms on their behalf
• In-app purchases by minors require parental consent and authorization

2.2 Parental Responsibility

Parents and guardians are responsible for supervising their children's use of our Services, including any purchases made. We strongly recommend enabling parental controls on your device and within the respective app store.

2.3 Geographic Restrictions

Our Services are available worldwide, except in jurisdictions where their use would be prohibited by applicable law. It is your responsibility to ensure that your use of our Services complies with all local laws and regulations in your jurisdiction.

3.1 Grant of License

Subject to your compliance with these Terms, JUP Game Studio grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use our applications on devices you own or control
• Access and use our Services for personal, non-commercial entertainment purposes

3.2 Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of our Services
• Reverse engineer, decompile, or attempt to extract the source code of our apps
• Use our Services to develop competing products or services
• Remove, alter, or obscure any proprietary notices or labels in our apps
• Use automated tools, bots, or scripts to interact with our Services
• Use our apps for commercial purposes without our prior written consent

3.3 Updates

We may update, modify, or discontinue our Services at any time. Updates may be required to continue using the Services and may be delivered automatically. These Terms apply to all updates and future versions of our apps.

🔑 4. User Accounts

4.1 Account Creation

Some features of our Services may require you to create an account or link a third-party account (such as Google Play Games or Apple Game Center). You agree to provide accurate, current, and complete information.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Keep your login credentials secure and not share them with others

• Not transfer your account to another person without our written consent

4.3 One Account per User

You may only create one account per person. Creating multiple accounts to circumvent bans, gain unfair advantages, or for any other reason violates these Terms and may result in all accounts being terminated.

4.4 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, without prior notice or liability.

💳 5. In-App Purchases

5.1 Purchase Terms

Our games offer optional in-app purchases ("IAP") that provide access to virtual items, currency, cosmetics, and other content. All purchases:

• Are processed by Google Play (Android) or Apple App Store (iOS)
• Are subject to the respective platform's purchase terms and refund policies
• Are final and non-refundable, except as required by applicable law or platform policy
• Require real currency; prices are displayed in your local currency where possible

5.2 Refund Policy

All refund requests must be submitted directly to Google Play or Apple App Store, as applicable. JUP Game Studio does not process refunds directly. Platform policies generally allow refund requests within a limited window (typically 48 hours on Google Play, and 90 days on the App Store under certain conditions).

5.3 Price Changes

We reserve the right to change the prices of in-app purchases at any time. Price changes will not affect purchases already completed.

5.4 Failed Purchases

If a purchase fails or is reversed after content has been delivered, we reserve the right to revoke the associated virtual items or currency. Contact us if you experience a legitimate failed purchase.

💎 6. Virtual Items & Currency

6.1 Nature of Virtual Items

Our games may include virtual currencies (e.g., coins, gems, tokens) and virtual items (e.g., characters, skins, power-ups). You acknowledge that:

• Virtual items and currencies have no real-world monetary value and cannot be exchanged for real money
• You do not own virtual items — you purchase a limited license to use them within our Services
• Virtual items are non-transferable and cannot be sold, gifted, or traded between accounts or platforms
• Virtual items obtained through gameplay (not purchase) are subject to the same restrictions

6.2 Expiration & Loss

Virtual items may expire, be modified, or be removed from the game at any time. You will not receive compensation for lost virtual items resulting from:

• Account termination due to Terms violations
• Game discontinuation (we will provide reasonable advance notice)
• Technical issues outside our reasonable control
• Your failure to use items within any applicable validity period

6.3 Prohibited Transactions

You may not sell, trade, or transfer virtual items or accounts through third-party platforms, marketplaces, or websites. Any such transactions are void and may result in account termination.

📢 7. Advertising

Our free games are supported by advertising. By using our Services, you agree that:

• Ads may be displayed within games, including banner ads, interstitial ads, and rewarded video ads
• Ad content is served by third-party networks (e.g., Google AdMob) and is subject to their policies
• Rewarded ads are always voluntary — you choose whether to watch them in exchange for in-game rewards
• We are not responsible for the content of third-party advertisements

You may opt out of personalized advertising as described in our Privacy Policy. Opting out will result in non-personalized ads being shown instead — you will still see ads.

🚫 8. User Conduct

To maintain a fair and enjoyable experience for all players, you agree not to:

8.1 Cheating & Exploitation

• Use cheat codes, exploits, automation software, bots, hacks, mods, or third-party software to gain unfair advantages
• Manipulate game mechanics, scores, or leaderboards through unauthorized means
• Exploit bugs or glitches (please report them to us instead)

8.2 Abusive Behavior

• Harass, threaten, bully, or abuse other players
• Use hate speech or discriminatory language based on race, ethnicity, gender, religion, sexual orientation, or disability
• Share content that is sexually explicit, violent, or otherwise inappropriate

8.3 Security & Integrity

• Attempt to gain unauthorized access to our servers, systems, or other users' accounts
• Interfere with or disrupt the integrity or performance of our Services
• Transmit viruses, malware, or any other harmful code
• Impersonate JUP Game Studio staff or other players

8.4 Commercial Misuse

• Advertise or promote products or services within our games without authorization
• Use our Services to collect user data for commercial purposes
• Sell, resell, or commercialize our Services or any part thereof

Violation of these conduct rules may result in immediate account suspension or permanent ban without notice or refund.

9.1 Our Intellectual Property

All content within our Services — including but not limited to game code, graphics, artwork, animations, audio, music, characters, storylines, logos, and trademarks — is the exclusive property of JUP Game Studio or its licensors and is protected by intellectual property laws worldwide.

9.2 No Ownership Transfer

Nothing in these Terms grants you any ownership rights in our intellectual property. The license granted in Section 3 is limited and does not include the right to:

• Use our trademarks, logos, or branding without prior written consent
• Create derivative works based on our games
• Reproduce, distribute, or publicly display our content outside the Services

9.3 Fan Content

We love our community! Creating fan art, videos, and non-commercial content about our games is generally permitted as long as it is clearly non-official, non-commercial, and does not damage our reputation. Commercial use of our intellectual property always requires written permission.

9.4 Copyright Complaints (DMCA)

If you believe that content in our Services infringes your copyright, please send a DMCA notice to [email protected] with the subject "DMCA Notice", including all information required under 17 U.S.C. § 512(c)(3).

✏️ 10. User-Generated Content

Some of our Services allow you to submit content such as usernames, profile names, or feedback ("User Content"). By submitting User Content, you:

• Grant JUP Game Studio a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, and distribute your User Content within our Services
• Represent that you own or have the necessary rights to submit the content
• Agree that your content does not infringe any third-party rights
• Understand that we may remove any User Content that violates these Terms

We do not claim ownership of your User Content, but we need the above license to operate our Services.

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you agree to the collection and use of data as described in the Privacy Policy.

12.2 No Guarantee of Availability

We do not guarantee that our Services will be available at all times, free from bugs or errors, or that defects will be corrected. We may modify, suspend, or discontinue any aspect of our Services at any time without liability.

12.3 Third-Party Content

Our Services may contain links to or integrate with third-party services (such as ad networks, analytics providers, and app stores). We are not responsible for the content, privacy practices, or availability of those third-party services.

12.4 No Warranty for Purchases

While we strive to ensure in-app purchases are delivered correctly, we make no warranty that virtual items will always be available, functional, or remain unchanged within the game.

⚖️ 13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JUP GAME STUDIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Loss of virtual items, virtual currency, or game progress
• Unauthorized access to or alteration of your data
• Any damages exceeding the amount you paid to us in the 12 months prior to the claim (or USD $10 if you haven't made any payments)

Some jurisdictions do not allow exclusion of certain warranties or limitations of liability, so the above limitations may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless JUP Game Studio and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of any third-party rights, including intellectual property or privacy rights
• Any User Content you submit
• Your violation of any applicable law or regulation

We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification by you.

15.1 Termination by Us

We may suspend or terminate your access to our Services at any time, with or without cause, and with or without notice, including if:

• You violate these Terms or our Community Guidelines
• We detect fraudulent, abusive, or illegal activity
• We discontinue the Service
• Required by law or legal process

15.2 Termination by You

You may stop using our Services at any time by uninstalling our apps. If you have an account, you may also request account deletion by contacting us at [email protected].

15.3 Effect of Termination

Upon termination:

• Your license to use our Services immediately ends
• Your account and all associated data may be deleted
• All virtual items, currency, and progress are forfeited with no compensation
• Sections on Intellectual Property, Disclaimers, Limitation of Liability, and Dispute Resolution survive termination

⚖️ 16. Dispute Resolution

16.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at [email protected] and give us 60 days to resolve the dispute informally. Most issues can be resolved quickly this way.

16.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or our Services shall be settled by binding arbitration, except for claims that may be brought in small claims court.

Arbitration shall be conducted on an individual basis. Class action lawsuits and class-wide arbitration are not permitted.

16.3 Exceptions

The following disputes are excluded from arbitration and may be brought in court:

• Intellectual property infringement claims
• Requests for emergency injunctive or equitable relief
• Small claims court eligible disputes

16.4 Time Limit

Any claim must be filed within one (1) year after the cause of action arises, or it will be permanently barred.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

For users in the European Union: Nothing in these Terms limits your rights under EU consumer protection laws or your right to bring claims before your local courts.

For users in Australia: Certain provisions of these Terms that are inconsistent with the Australian Consumer Law are modified to the extent necessary to comply with that law.

For users in South Korea: These Terms are subject to the Act on the Consumer Protection in Electronic Commerce and other applicable Korean consumer protection laws.

📝 18. Changes to Terms

We may update these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Display a notice within the affected app(s)
• Send an email notification to users who have provided their email address (for significant changes)

Your continued use of our Services after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our Services and uninstall our apps.

We will not make retroactive changes that substantially reduce your rights without giving you appropriate notice and a reasonable opportunity to stop using the Services.
